Maximiliano Galindo, civil rights attorney with Curd Galindo & Smith, LLP, filed a $1,000,000 government tort claim, which is a precursor to filing a lawsuit with the County of Ventura. Official records of the county allege that the claim was filed on April 9, 2025. The records show that Mr. Galindo’s client, Jaiden Perkins, filed his claim alleging that he was beaten and battered by off-duty Ventura County sheriff deputies.

In the early morning hours of 03/30/2025, at approximately 12:10 am, Perkins was working security at El Rey Cantina in Camarillo, CA. Perkins was approached by an unknown individual (Dylan Davis), and asked if Mr. Perkins was taking pictures of the individuals in his party. Perkins quickly said no and showed Deputy Davis his phone.

Approximately 10 minutes later, Perkins noticed a Caucasian female in her late 20s/early 30s hysterically crying. As he investigated further, he noticed an altercation had occurred between the female and her husband, Deputy Davis. The group vacated the establishment to the rear parking lot by the trash cans. Perkins observed them to make sure they were not fighting or creating a disturbance.

Perkins then observed the Caucasian female and her other female friend exit the El Rey Cantina to the front. Perkins followed them to make sure everything was okay. Perkins saw them sit on the bench in front of the El Rey with the statue placed on it. Perkins asked them if they were okay, and it appeared they were. Perkins re-entered El Rey.

Perkins began putting the outdoor chairs inside as the El Rey was beginning to close. As Perkins went out there, he saw the Caucasian female’s husband, Deputy Davis, back in her vicinity. Perkins stayed to observe his behaviour. Perkins observed the wife slap Deputy Davis and say, “Don’t you ever talk to me like that again”. Perkins then approached slowly and he observed Deputy Davis shove her into the bench. Perkins then saw the wife stand up, and Deputy Davis began choking her. Perkins yelled out, “Hey man, you can’t be touching females like that”. Deputy Davis then stopped choking her, and immediately looked at Perkins and said, “I’ll f…ing kill you.” Then he proceeded to strike Perkins with his left hand to Perkin’s right cheekbone.

Perkins defended himself by swinging back, landing his left hand, and Deputy Davis fell to the floor. At this time, his friend, Deputy Anthony Malagon, came from the rear parking lot area and tackled Perkins. Both Deputy Davis and Deputy Malagon began kicking and punching Perkins in the head, announcing themselves as Ventura County Deputy Sheriffs.

Ventura County Sheriffs responded, and Perkins was evaluated by paramedics and taken to Pleasant Valley Medical Center by ambulance.

Perkins was diagnosed with a locked jaw, loss of consciousness, concussion, as well as head and neck injuries.

Perkins now suffers from continued daily head and neck pain.

Perkins contends in the claim that Deputy Davis and Deputy Malagon acted under color of authority and assaulted, battered and violated his civil and constitutional rights, including unlawful search and seizure.

According to a Press Release from Ventura County Sheriff Fryhoff via Santa Paula Times (https://www.facebook.com/SantaPaulaTimes2018), both deputies were immediately placed on Administrative Leave pending the outcome of the investigation. Davis was arrested for 242 PC (Misdemeanor Battery), 243(d) PC (Battery Causing Serious Injury), 245(a)(4) PC (Force Likely to Cause Significant Injury), 273.5(a) PC (Inflict Corporal Injury on a Spouse), and 422 PC (Criminal Threats). Malagon was arrested for 243(d) PC (Battery Causing Serious Injury) and 245(a)(4) PC (Force Likely to Cause Significant Injury).
